By accessing, using, or submitting material for or posting on involved.edmonton.ca, (the "Site") you accept and agree to comply with the following Terms of Use. If you do not agree with these Terms of Use, you should immediately discontinue any access to or use of this Site. These Terms of Use are subject to change from time to time. You should visit this web page periodically to review the Terms of Use that govern your access and use of the Site and are binding on you. For the avoidance of doubt, “you” refers to anyone who accesses, uses, submits Material to or posts on the Site.

License

The City of Edmonton ("The City") grants you a limited non-exclusive, non-transferable license to access and make personal, non-commercial use of the Site, provided the Site is not modified or downloaded (other than page caching) unless expressly authorized or permitted by The City. You will be fully responsible for any consequences resulting from any use. Any unauthorized use of the Site will terminate the license and all the limited rights or permission granted by The City.

Copyright and intellectual property rights

The City owns the intellectual property rights, including copyright, or has acquired the necessary licenses, in the information including all text, graphics, images, HTML code, multimedia clips, icons, the selection and compilation of the contents of the Site (collectively the "Contents"). All rights reserved.

The City grants you a worldwide, royalty-free, perpetual, non-exclusive licence to use the Contents, subject to these Terms of Use. You may copy, modify, publish, translate, adapt, distribute or otherwise use the Contents in any medium, mode or format for any lawful, non-commercial, personal, or educational purpose; however, no rights whatsoever are granted in the software used to make this site available (including but not limited to any software code).

Where you copy, modify, publish, translate, adapt, distribute, or otherwise use the Content as permitted above, you must acknowledge the source of the Contents and, where possible, provide a link to these Terms of Use.

You are not granted any right to use:

  •  Personal information (as defined in the Freedom of Information and Protection of Privacy Act, R.S.A. 2000, c. F-25);
  • Third party rights The City is not authorized to license;
  • The names, crests, logos, or other official symbols of The City; and
  • Content subject to other intellectual property rights, including patents, trade-marks and official marks.

Notwithstanding anything in these Terms of Use, you are required to comply with all applicable laws, including all applicable Canadian and international intellectual property laws.

Non-endorsement

These Terms of Use do not grant you any right to use the Contents in a way that suggests any official status or that The City endorses you or your use of the Contents.

Participation in online discussion groups, comments & other communications

You may post or submit comments, suggestions, ideas, questions, or other information (“Material”) on the Site, provided the Material is not prohibited. Material that is prohibited by these Terms of Use includes but is not limited to the following:

  • Illegal/criminal activity (criminal or civil violations of applicable laws, regulations, bylaws, policies, ministerial orders, or rules, including but not limited to theft or infringement of copyrights, trademarks, trade secrets, or other types of intellectual property; fraud; forgery, theft or misappropriation of funds, credit cards, or personal information; defamation; or threats of physical harm or harassment);
  • Security violations (attempts – whether or not successful – to violate the security of a network, service or other system, including but not limited to hacking, cracking into, monitoring, or using systems without authorization; scanning portal conducting denial of service attacks and distributing viruses or other harmful software);
  • Threats (materials of a threatening nature, including but not limited to threats of death or physical harm, harassment, libel, or defamation);
  • Offensive materials (including but not limited to obscene, profane, indecent, racist, and hateful materials); and
  • Any form of “spam”.

You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of such content.

If you post or submit any Material, you grant The City an irrevocable, non-exclusive, royalty-free, right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and sub-license such use of such content or material world-wide. You fully and irrevocably waive all moral rights to such Material. You represent and warrant that you own or otherwise control all rights to any Material posted or submitted and that your Material does not violate these Terms of Use or other City policy and will not cause injury to any person or entity; and that you will indemnify The City for all losses, damages, fines, costs, injuries or claims resulting from Material you supply.

The City takes no responsibility and assumes no liability for any Material posted by you or any third party. The City reserves the right to monitor and edit or remove any activity or material or inactivate any account that appears to violate these Terms of Use or guidelines for participating in an online discussion. If you repeatedly submit or post prohibited Material, The City reserves the right to prohibit or block you from further activity on the Site.

You are responsible for safeguarding your own password and ensuring any information you supply is accurate. The City is not liable for any losses, damages, fines, costs, injuries or claims resulting from your failure to properly safeguard your password or supplying inaccurate information.

Limitation of liability, disclaimer of warranties and conditions

The Contents and any services are provided in good faith on an "as is" basis and were current at the time of posting for use on the Site. The City and its third party provider who hosts/develops the Site are not required to provide regular or any updates to the Contents or format of the Site.

The City and its third party provider who hosts/develops the Site disclaim all warranties or conditions, express or implied, in respect of the Contents and any services considered by these Terms of Use, including without limitation, implied warranties and conditions of merchantability and fitness for any particular purpose, non-infringement or accuracy. This disclaimer applies to the fullest possible extent in jurisdictions that limit the exclusion of implied warranties.

The City and its third party provider who hosts/develops the Site are not responsible for any liability of any kind for any direct, indirect, incidental, consequential or other losses, damages, fines, costs, injuries or claims resulting from the use, misuse or misinterpretation of any Content or services provided by this Site.

Indemnity

You agree to indemnify, defend and hold harmless The City and its third party provider who hosts/develops the Site and their respective officials, officers, employees and authorized representatives, as applicable, from and against any liability, loss injury (including injuries resulting in death), demand, action, cost, expense, or claim of any kind, including but not limited to lawyer's fees, relating in any way to your use of the Contents or any services provided by this Site.

These other Web sites, with the exception of The City’s official website at www.edmonton.ca, were independently developed by parties other than The City and The City assumes no responsibility for the accuracy or appropriateness of the information contained in such Web sites. If you decide to access linked third party Web sites, you do so entirely at your own risk. When you visit another site, please review their terms of use. The City’s official website at www.edmonton.ca is governed by separate Conditions of Use.

You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the Site, so long as the link does not portray The City, its officials, its employees, or its Content, products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any logo or other proprietary graphic or trademark of The City as part of the link or otherwise without express written permission.

Site policies, modification and severability

We reserve the right to make changes to our Site, policies or Terms of Use and provide any additional terms at any time. The changes or additional terms are effective immediately upon their posting on the Site. Your use of the Site will be subject to the Terms of Use posted on the Site at the time of use. In the event any of these conditions should be determined to be invalid, void, or for any reason unenforceable, that condition will be deemed to be severable and will not affect the validity and enforceability of any remaining conditions.

Termination

If you violate these Terms of Use or other policies and guidelines posted on this Site, your permission to use the Content automatically and immediately terminates and you must immediately destroy any copies you have made of the Content. The City reserves all of its rights at law and in equity.

Governing law and jurisdiction

Your use of the Site is governed by the laws of the Province of Alberta. You agree and submit to the exclusive personal jurisdiction and venue of the courts located in Edmonton, Alberta.

Descriptions

The City has attempted to be as accurate as reasonably possible, however, it does not warrant that Contents of the Site are accurate, complete, reliable, current, or error-free. The City makes no warranty for any Material posted by users of the Site.

Request for permission/further information

Any use beyond the scope permitted by these Terms of Use requires express written permission from The City. The requirements for obtaining written permission may include but is not limited to an additional formal license agreement to which a license fee may apply. The City and its third party service provider who develops/host the Site may collect aggregate, anonymous transactional and performance data related to the use of the software and use such data for business purposes (including use optimization of the software and product marketing), but will not reveal the identity of any user of the Site, including you
